Terms and Conditions:
1. Introduction
Welcome to Cayman Comfort. By booking and staying at our property, you (the Guest) agree to the following Terms and Conditions. Please read them carefully as they contain important information regarding your stay.
2. Booking and Payment
2.1. Reservation: Reservations will not be accepted without a deposit. 50% of total stay is required at checkout. The credit card for the initial deposit will be held on file. Full payment of the remaining 50% will be charged sixty (60) days prior to arrival on the same credit card. For cancellation policy, please see section 5.
2.2. Payment Methods: We accept Visa, Mastercard, Discovery, American Express, E-check, JCB, PayPal, and Apple Pay.
2.3. Rates: The rates listed at the time of booking are final and include all applicable taxes and fees unless otherwise stated.
3. Check-In and Check-Out
3.1. Check-In Time: Check-in is available starting from 3:00 PM on the day of arrival.
3.2. Check-Out Time: Check-out is required by 11:00 AM on the day of departure.
3.3. Early Check-In/Late Check-Out: Requests for early check-in or late check-out are subject to availability and extension of lease terms.
4. Amenities
4.1. Amenity Items: We offer complimentary bath amenities in each bathroom, including shampoo, conditioner, soap and lotion. Toilet paper, paper towels, bath soaps, hand soaps, dishwashing detergent and laundry detergent are also provided for you at the beginning of your stay.
4.2. Coffee and Tea Bar: Nespresso and Keurig machines are provided along with a supply of coffee pods and a selection of teas at the beginning of your stay. Additional coffee and tea supplies, if desired, can be readily purchased on island.
4.3. Wi-Fi: Complimentary, unlimited Wi-Fi is included with your stay. Simply sign onto our network using the information provided in the guidebook provided at the Property.
4.4. Baby Amenities: A complimentary pack ‘n play, highchair, and baby gate for stairs can be provided at your request.
5. Cancellation Policy
5.1. Cancellation by Guest: 50% of paid prepayments refundable when canceled 30 day(s) before arrival or earlier. No refunds will be issued for cancellations made less than thirty (30) days of check-in.
5.2. Cancellation by Host: In the unlikely event that we must cancel your booking, a full refund will be provided. We will not be liable for any other costs associated with the cancellation.
6. House Rules
6.1. Occupancy: The maximum number of guests allowed is 10 not including infants. Exceeding this limit without prior approval may result in immediate termination of the rental agreement without refund.
6.2. Noise: Guests must respect the neighbors and maintain noise levels at a minimum, especially during quiet hours from 10:00 PM to 8:00 AM.
6.3. Smoking: This is a non-smoking property. Smoking is strictly prohibited inside the property. An additional $500 fee will be charged for cleaning.
6.4. Parties and Events: Parties and events are not allowed unless prior approval is obtained. Violations may result in immediate termination of the rental agreement without refund.
6.5. Cleanliness: Guests are expected to leave the property in the same condition as it was at check-in. Additional cleaning fees may apply if the property is left in an unacceptable condition.
7. Security Deposit
7.1. A security deposit of 10% of total stay is required and will be charged the day prior to arrival and will be refunded within 5 days after check-out, provided no damage is found, and all terms and conditions are met.
7.2. Any damage to the property or its contents during the stay will be deducted from the security deposit, and if the damages exceed the deposit, the Guest will be responsible for additional costs.
8. Hurricane and Severe Weather
8.1. Hurricane Watch: A "Hurricane Watch" is issued when there is a possibility of hurricane conditions within 48 hours. If a Hurricane Watch is issued for the area where the Property is located, the Guest may choose to:
Reschedule the Stay: The Guest may reschedule their stay for a future date, subject to availability and any applicable rate differences. No rescheduling fee will be charged.
Cancel the Reservation: The Guest may cancel their reservation and receive a full refund of any amounts paid, minus any non-refundable fees (e.g., service fees, if applicable).
8.2. Hurricane Warning: A "Hurricane Warning" is issued when hurricane conditions are expected within 36 hours. If a Hurricane Warning is issued for the area where the Property is located, the following options are available to the Guest:
Evacuation: If local authorities issue a mandatory evacuation order for the area, the Guest must comply and vacate the Property immediately.
Refund and Evacuation: If the Guest is required to evacuate due to a mandatory order, a full refund will be provided for the unused portion of the stay.
Relocation Assistance: The Property Owner/Manager may assist in finding alternative accommodation for the Guest, but this is not guaranteed.
8.3. Early Termination: If a hurricane or severe weather causes the Property to become uninhabitable during the Guest's stay, the reservation may be terminated early. The Guest will receive a prorated refund for the unused portion of the stay.
8.4. Travel Insurance: Guests are strongly encouraged to purchase travel insurance that covers weather-related cancellations. The Property Owner/Manager is not responsible for any travel-related issues outside the terms mentioned here.
8.5. Limitation of Liability: The Property Owner/Manager is not liable for any personal injury, loss, or damage to personal property resulting from a hurricane, storm surge, or other severe weather event. The Guest assumes all risks associated with staying at the Property during such events.
9. Travel Insurance
9.1. We strongly recommend obtaining travel insurance for your stay to protect you from unexpected circumstances that may interrupt your stay.
10. Liability and Indemnification
10.1. The Guest agrees to indemnify and hold harmless the Host from any liability, loss, or damage arising from the use of the property, including any claims arising from injury or death.
10.2. The Host is not responsible for any loss, theft, or damage to the Guest's personal property during the stay.
11. Termination of Rental
11.1. The Host reserves the right to terminate the rental agreement immediately if the Guest breaches any of these Terms and Conditions. In such cases, no refund will be issued.
11.2. Fraud, Misrepresentation, or Violation: In the event that this reservation has been obtained under false pretenses, or in the event the Guest or the Rental Party (or any other persons granted access to the Property during the Lease Term) violates any term of this Agreement, the Property Owner shall have the right to deny check-in or evict the Rental Party without refund. The Guest agrees to save, indemnify and hold harmless the Property Owner and Cayman Comfort from and against any and all losses directly or indirectly attributable to any such false pretenses or violations.
12. Governing Law
12.1. This Agreement shall be governed by and construed in accordance with the laws of the Cayman Islands.
13. Miscellaneous
13.1. Amendments: The Host reserves the right to amend these Terms and Conditions at any time. Guests will be notified of any significant changes before their stay.
13.2. Entire Agreement: These Terms and Conditions constitute the entire agreement between the Guest and the Host and supersede any prior agreements or understandings.
